Everyone is consumer from birth till death, rich or poor, powerful or weak, literate or illiterate. The consumer is King, the economy moves upon the moods of the consumers and their desires to buy any goods or avail any services. The cosmopolitan attitude among the younger generations compel the manufacturers to produce new products every day, that's makes the consumer laws more and more relevant.

Though the consumer protection act & rules cover almost every kind of services and goods related affairs, but then also it excludes every commercial transaction. The purpose of this act is to protect the interest of every end-user from any or every malpractices of the manufacturer or trader.

Although the consumer law is a part of law of Tort, but like any other law in India the Consumer Law is also codified, which not only help us to understand its procedure & technicalities, but also provides fair and transparent opportunity to contest. Though the law is very vast but to give a brief idea the relevant and important legislations, related to the subject are:-


Real Estate& RERA Affairs

The estate refers thing or things belongs to someone possessions, includes exclusive right to enjoy & dispose a thing. The real estate sector plays a catalytic role in fulfilling the need and demand for housing and infrastructure in the country. While this sector has grown significantly in the recent years, it has been largely unregulated, in absence of professionalism and lack of adequate consumer protection.

The Builder-Buyer-Developer relationship are usually governed by the Consumer Protection Act, but looking to the need of the growing society, more particularly in real estate sector, where the development work is in progress everywhere, it is requirement of law to established a specific authority to govern the affairs relating to Real Estate.

The Real Estate (Regulation and Development) Bill, 2013 proposed uniformity and standardization of business practice and trisections in the real estate sector. The bill was passed in the month of March, 2016 in both the houses ofthe Parliament and the Real Estate (Regulation and Development) Act, 2016 came in force. The Real Estate Regulatory Authority (RERA) seeks to protect the buyers as well as boost investments in the real estate industry, under this Act.

The Real Estate (Regulation and Development) Act, 2016, is an additional remedy with the existing Consumer Protection Act. Though the debates are open with regard to the jurisdiction and enforceability of these act relating to the matter covered under both the acts at a same point of time.
